We share some of the above information with a third-party identity verification service, Veriff, in order to verify your identity, prevent fraud and comply with regulatory requirements. Our verification processes involve electronic identification through the comparison of your ‘selfie’ against your provided verification information. This information may constitute biometric information or biometric identifiers under applicable law. Veriff processes your biometric information and may create derivative data that can be used in connection with the provision of identity verification and fraud prevention services. Veriff, not Copart, stores and processes this information and acts as a data controller in their own right, meaning that you should carefully review their Privacy Policy, Retention Policy and associated documentation to understand how your Personal Data including biometric identifiers or biometric information may be processed.

In addition, we may also disclose your Personal Data in the following circumstances:

  • With our affiliates or others within our corporate group.
  • In connection with or anticipation of the sale of a business (including merger, acquisition, or sale of all or a material portion of the business’s assets, change in corporate control, or other business transaction, including in the context of insolvency or bankruptcy proceedings).
  • With professional advisors, such as auditors, law firms, or accounting firms.
  • To enforce our contracts (including our Terms & Conditions); to ensure the safety and security of our employees, users and third parties; to protect our rights and property and the rights and property of our users and third parties; and to comply with legal process, including pursuant to a judicial warrant, rule, order or subpoena, or in other cases if we believe in good faith that disclosure is required by law or regulation, in each case, without obligation to contest such legal process.
  • Under limited circumstances in which we obtains your contemporaneous consent. We have established business partners who work with us to purchase vehicles directly from individuals. When we are not able to purchase your vehicle, if you direct us to do so, we may share your Personal Data with one of those business partners.

 

Promotional Marketing 

Depending on the location in which you are located and, if applicable, when you provide your affirmative consent, we may use your identity, contact, technical, usage and transaction data to form a view on what products or services we think you may want or need, or what may be of interest to you, and provide you with information on such products and services. This is how we decide which products, services and offers may be relevant to you.

Withdrawing Consent for Promotional Marketing

Depending on the laws of the jurisdiction in which you reside, we have established a preference center through which members may opt-out of direct marketing. The same category of members may also opt-out of promotional marketing by submitting your request to privacy@copart.com. All recipients of marketing and promotional communications from us may opt-out of future marketing communications by clicking on the link that we include at the bottom of all of our marketing communications.

International Transfers 

For the purposes of the EU and UK General Data Protection Regulation (GDPR), some recipients of your Personal Data are located outside of your country (your country being located within UK, European Union (EU) and/or European Economic Area (EEA)) or have offices in countries where data protection laws may provide a different level of protection than the laws in your country. When transferring Personal Data to such recipients, we provide appropriate safeguards:

  • The transmission of Personal Data between and among certain members of the Copart Group, which consists of Copart, Inc. and its direct and indirect wholly-owned subsidiaries, is based on our worldwide data protection principles contained in our Intra-Group Processing Agreement, which incorporate both controller to controller and controller to processor model clauses prescribed by the European Union and the international data transfer agreement (IDTA) and/or the international data transfer addendum to the European Commission's standard contractual clauses, for international data transfers, which have been issued by the Information Commissioner's Office pursuant to Section 119A of the Data Protection Act 2018. Through our Intra-Group Processing Agreement, the Copart Group undertakes to protect your Personal Data and to comply with applicable data protection obligations.
  • For other third parties which are not in territories deemed to be adequate by the European Commission, we may use the international data transfer agreement (IDTA) and/or the international data transfer addendum to the European Commission's standard contractual clauses, for international data transfers, which have been issued by the Information Commissioner's Office pursuant to Section 119A of the Data Protection Act 2018.

Your Rights and Choices

Exercising Your Rights

You may generally exercise one or more of your rights described above free of charge. When requests are manifestly unfounded or excessive, in particular because of their repetitive character, we may charge an appropriate fee in accordance with the applicable regulations or refuse to process the application.

We may need to collect information from you to verify your identity, such as your email address, government issued ID or date of birth, before providing a substantive response to the request. Depending on your location, you may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. While Copart does not sell your personal information for money, we work with third-party companies for advertising and marketing purposes and we disclose your information to third parties in a manner that some US state laws consider “selling” or “sharing”.
